You agree not to misuse this website, attempt to damage it, interfere with its security, copy its content without permission, or use it for unlawful purposes.
3. No Client Relationship From Website Use
Using this website, submitting a contact form, requesting a quote, or booking a consultation does not create a client relationship.
A client relationship begins only when both parties agree to move forward with a project, usually through a written proposal, agreement, invoice, or other written confirmation.
4. Quotes, Consultations, and Website Audits
James Velardi Design may offer free consultations or website audits.
A free consultation or audit is meant to provide general feedback, recommendations, and project guidance. It does not guarantee that James Velardi Design will accept a project or that a specific result will be achieved.
Any quote or estimate provided is based on the information available at that time. Final pricing may change if the project scope, requirements, timeline, features, content, or deliverables change.
5. Project Terms
Each project may have its own proposal, scope of work, timeline, payment terms, revision terms, and deliverables.
If a separate project agreement, proposal, or invoice conflicts with these Terms & Conditions, the project-specific agreement will control for that project.
Project work may include items such as:
- Custom WordPress website design
- Website redesigns
- Website maintenance
- SEO setup
- Google Business Profile setup
- WooCommerce setup
- Contact forms
- Website copy support
- Excel dashboards
- Data organization
- Other agreed-upon digital services
6. Payments and Invoices
Payment terms will be explained in the project proposal, invoice, or written agreement.
James Velardi Design may require a deposit, milestone payment, or full payment before work begins, before launch, or before final files, credentials, or deliverables are transferred.
Late payments, unpaid invoices, or delayed responses may delay project timelines, launch dates, handoff, or ongoing support.
7. Client Responsibilities
To complete a project, clients may need to provide:
- Business information
- Website content
- Images or brand assets
- Logo files
- Login credentials
- Domain or hosting access
- Product or service details
- Feedback and approvals
- Other materials needed for the project
Delays in providing required information, access, content, or approvals may delay the project timeline.
Clients are responsible for making sure any content, images, logos, trademarks, videos, documents, or other materials they provide are accurate and that they have the legal right to use them.
8. Website Content and Accuracy
James Velardi Design may help organize, edit, or improve website content, but clients are responsible for reviewing and approving all final content before launch.
This includes business descriptions, service details, pricing, disclaimers, contact information, claims, images, legal content, and any industry-specific requirements.
James Velardi Design is not responsible for inaccurate, outdated, incomplete, or legally non-compliant information provided or approved by the client.
9. SEO and Marketing Results
James Velardi Design may provide SEO setup, local SEO support, Google Business Profile setup, website structure improvements, and lead-generation-focused design.
However, James Velardi Design does not guarantee specific rankings, traffic numbers, leads, sales, revenue, Google placement, or business results.
Search engine rankings and website performance can depend on many factors outside of our control, including competition, market conditions, content quality, backlinks, customer behavior, Google algorithm changes, website history, and ongoing marketing efforts.
10. Website Maintenance and Third-Party Tools
Websites may use WordPress, themes, plugins, hosting providers, form tools, analytics tools, booking tools, payment tools, security tools, email services, or other third-party platforms.
James Velardi Design is not responsible for outages, pricing changes, plugin conflicts, security issues, discontinued services, policy changes, or technical problems caused by third-party providers.
Website maintenance services, if provided, will be based on the agreed scope of work.
11. Portfolio Use
Unless otherwise agreed in writing, James Velardi Design may display completed work in a portfolio, case study, social media post, proposal, or marketing material.
This may include screenshots, project descriptions, links to the live website, or general information about the project.
If a client does not want their project shown publicly, they should request this in writing before the project is completed.
12. Intellectual Property
The content, design, layout, graphics, images, branding, text, and other materials on this website belong to James Velardi Design or are used with permission.
You may not copy, reproduce, modify, distribute, or reuse website content without written permission.
